Our terms and conditions
These hire terms and conditions (“Terms & Conditions”) will help you understand what you can expect from us and what we need from you to make sure we can complete your booking successfully.
Definitions
In these Terms & Conditions: (a) “owner” means Stop Gap Sofas Limited, hereafter referred to as “us” and “we” or “SGS”; (b) “hirer” means the individual, hereafter referred to as “you” and “your”; (c) “hire agreement” means the contract between you and us detailing the sofa(s) hired, hire charges and hire period; and (d) “hire period” is the period of hire of a sofa in each case, unless agreed otherwise by the owner, commencing on the date the sofa is dispatched to you.
Terms
1. We agree to hire out to you the sofa(s) detailed in the hire agreement on the terms and conditions set out herein.
2. You agree to pay SGS on demand all charges due hereunder including where relevant any additional charges, delivery charges, VAT or other taxes thereon.
3. The hire charges and delivery charges are those specified in the owner’s current hire price guide at the time the hire agreement is received by the owner or as otherwise notified to the hirer by the owner.
4. A £300 deposit is required from the hirer for each sofa hired. The deposit will be repayable in full on the return of the sofa in a satisfactory condition subject to any costs incurred by the owner in clause 5 above.
5. Any damage to the sofa(s) is the responsibility of the hirer. You undertake to ensure the sofa(s) are in the same condition at collection as when received. If special cleaning or repair work is required for whatever reason we will make a separate charge to cover the cost of any such cleaning and/or repair work.
6. If the hirer wishes to extend the hire period, the hire charges for such additional hire period shall be as specified in the owner’s current hire price guide and the hirer will be required to resubmit credit or debit card details at such time.
7. Sofas are hired at a weekly rate at the agreed charge. Charges cannot be reimbursed if the sofas are returned prior to the end of the hire period.
8. At the end of the hire period it is your responsibility to ensure that we have access to the location specified in the hire agreement to collect the sofa(s) at the designated time.
9. In the event the hirer is not at home to enable collection of the sofa(s) at the mutually designated time at the end of the hire period, the hirer will be liable for and will be charged a failed collection charge of £30. The hirer must give the owner no less than 48 hours notice of any proposed change to the collection time or date.
10. We accept no responsibility for damage or injury whilst our sofas are under hire to you.
11. All sofas are checked on delivery and your signing of the hire agreement indicates acceptance of the sofas as being in good and clean condition.
12. The hirer shall in no circumstances remove a sofa from the address specified for delivery and collection overleaf without obtaining the consent of the owner in writing specifying the address in all cases to which the sofa is to be removed.
13. The hirer during the hire period will not sell or offer for sale, assign, underlet, lend or otherwise deal with a sofa in a manner prejudicial to the owner's rights, but will keep each sofa in its possession and will protect the same against distress, execution or seizure and indemnify the owner against all losses, costs, charges, damages and expenses incurred by it by reason or in respect thereof.
14. By agreeing to hire a sofa you irrevocably authorise SGS to debit your nominated payment card to recover all charges and amounts due and owing to SGS. You confirm that the payment card that is being used is yours and that there are sufficient funds or credit facilities to cover the charges.
15.SGS shall deliver the sofa(s) to the delivery address, which you supply, provided this is a valid UK address. SGS will use their best endeavours to advise you if there is likely to be a delay in dispatching your order and not accept liability for any failure to deliver within that time.
16. The hirer is responsible for ensuring that, prior to placing an order, the sofa(s) you have ordered will fit through all access points up to and including the room for which they are intended. In the event of this not being the case the hirer will be liable for a failed delivery charge of £30 or the sum of your delivery charge, whichever is the greater. All measurements of our hire sofas can be verified on our website.
17. SGS may at any time assign any of their rights and/or transfer, sub-contract or delegate any of their obligations under these terms and conditions. These terms and conditions are personal to you and are entered into by you for your own benefit and not for the benefit of any third party.
18. SGS may amend these terms and conditions from time to time and post the new version on its website.
19. These terms and conditions, together with the Privacy Policy, the Web-site Terms and Conditions, hire agreement and payment method instructions, if any, contain the entire agreement between you and us. You acknowledge and agree that you have not entered into these terms and conditions in reliance on any statement or representation of any person other than as expressly incorporated in these terms and conditions.
20. These terms and conditions are governed by and are to be construed in accordance with English law. You and SGS irrevocably agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute that may arise out of or in connection with these terms and condition.
